HO AN’IZAY MAHAY TENY ANGLISY ITY MANARAKA ITY
Acting Judge MH Mabena (Constitutionnal Court of South Africa) had heard a case between the former president of Madagascar, Marc Ravalomanana, living in South Africa after a coup in his country during 2009, and a group of eight Malagasy applicants. Originally the eight wanted a court order preventing Ravalomanana from leaving South Africa and making him hand his passport to the court registrar. This was so that he would have to stay here while the Directorate for Priority Crime Investigations (the Hawks) continued trying to establish whether Ravalomanana should be charged with crimes against humanity. When the matter was argued in September, however, the eight suggested a compromise approach to the travel restrictions.
Afterwards, both sides filed heads of argument and Acting Judge Mabena then wrote a decision which he delivered on November 19. During Nel’s speech at The Hague he said South Africa took its obligation to co-operate with the ICC seriously. But, he said, despite new internal laws to ensure co-operation, it wasn’t always easy to provide the assistance needed to investigate such crimes.
Acting Judge Mabena’s decision gives us a glimpse into some of these difficulties.
The eight applicants claim Ravalomanana has committed crimes against humanity, with responsibility for the killing of many civilians by the presidential guard in Antananarivo in 2008 and 2009. In 2010, Ravalomanana was tried in absentia by a Madagascan court, convicted of murder and sentenced to life imprisonment. Since his arrival in South Africa, originally seeking political asylum, Ravalomanana has been given permanent residence.
The acting judge outlined some of the terms of Ravalaomanana’s continuing stay in South Africa, noting that while he was offered limited VIP protection, there were also curbs on his freedom to which he had agreed. The applicants feared that if he left South Africa our courts would lose jurisdiction and the local investigation against him would have to stop. Instead they want the investigation to be finalised and appropriate action taken.
They told the court that the Hawks were trying to establish whether Ravalomanana was involved in crimes against humanity involving murder and torture as part of a widespread systemic attack directed at a civilian population. They also referred to claims that, while living in South Africa, he was involved in a plot to kill Malagasy officials.
Ravalomanana’s legal team argued that his movement should not be restricted. Not even the Rome Statute, setting up the ICC, permitted South African courts to make an order conflicting with our Bill of Rights: like anyone else, he was entitled to travel freely.
The judge, however, pointed to Constitutional Court decisions holding that under certain conditions rights may be limited, and he sanctioned restrictions on Ravalomanana’s freedom of movement so as to facilitate investigations. He can travel freely within South Africa while his passport is lodged with the investigating team; travel abroad, however, is limited to attending Southern African Development Community (SADC) meetings and then only as long as a formal, written SADC invitation is presented to the investigation team. He may also travel to Madagascar if there’s an official SADC recommendation to that effect. But once he’s back, his passport must be returned within 72 hours.
It’s not clear how much this outcome will satisfy either side – or the investigators. But the case does illustrate that South Africa, as part of the wider world, can’t escape involvement in the problems of how to support the ICC in its work of ensuring there’s no impunity for anyone who commits crimes against humanity.
